Os autores eram proprietários do trapiche Sul Americano que em 13/10/1920 sofreu incêndio casual e pediu da ré a indenização de sinistro. Havia efetuado seguro juntamente com a Companhia Anglo Sul Americana, de 100.000$000 réis. O incêndio destruiu 250 fardos de papel pertencentes a S. Paes Barreto e 238 fardos de algodão de Luiz S. S. Guimarães. A ré tinha responsabilidade de 150:000$000 sobre o total de 250:00$000, pois após vistoria provou-se a mercadoria ser segurada. Pediu-se condenação da ré no pagamento.
