A autora alugou ao réu o próprio nacional situado na Rua Ricardo Machado, 52, Rio de Janeiro, pelo aluguel mensal no valor de 90$000 réis. O réu não tinha pagado os aluguéis que lhe eram devidos. Fundamentada no Decreto nº 3084 de 1898, artigo 422 e no Código Civil, artigo 1202, a autora requereu um mandado executivo, a fim de haver o pagamento sob pena de penhora dos bens. O juiz deferiu o requerido.
