O autor requereu uma ordem de habeas corpus em favor do paciente belga violonista da Orquestra do Teatro Phenix, que fora preso sem flagrante ou nota de culpa e ameaçado de deportação, expulsão. No ofício emitido pela Secretaria de Polícia do Distrito Federal era informado que o estrangeiro fora preso durante estado de sítio por motivo de ordem pública. O juiz denegou o pedido.
