O impetrante, advogado, requereu uma ordem de habeas corpus em favor do paciente, que estava ameaçado de prisão por ser insubmisso, já que fora sorteado para o serviço militar ativo. Alegou ser o paciente isento do serviço por ser arrimo de família. O juiz concedeu a ordem impetrada e remeteu os autos ao STF, este acordou negar provimento ao recurso, mantendo a ordem impetrada de conceder o habeas corpus.
