Trata-se de justificação para fins de recebimento de pensão, onde o justificante, mulher, viúva do finado Gregório Eugênio Lopes da Costa, pai legítimo de sua filha Olga, menor. Trata-se de prova judicial acerca de alguma coisa, ou seja, prova da existência ou inexistência de ato ou relação jurídica que pretende a parte interessada. Constitui-se através de jurisdição voluntária, isto é, a parte interessada que procura o Poder Judiciário e nunca a recíproca.
