Trata-se de inquérito da terceira delegacia auxiliar de polícia que apurou que o suplçicado em 1919 usando documentos falsos tentou alistar-se eleitor. este crime está previsto no cod Penal art 256, mas esse artigo, segundo reiteiramente o STF, está revogado, motivo pelo qual o suplicante requereu o arquivamento do inquérito. O réu era italiano solteiro e chofer. O juiz mandou arquivar o processo.
