Trata-se de um inquéiro policial referente a fraude no processo de alistamento eleitoral do réu, que instrui-o com o registro de nascimento a fim de afirmar-se brasileiro. O réu é imigrante português. Por se tratar de um crime político foi abrangido pela anistia concedida pelo governo provisório de Getúlio Vargas aos responsáveis por crimes eleitorais ocorridos até 24/10/1930.
