O Procurador Adjunto dos Feitos da Saúde ofereceu uma denúncia contra o réu, pois este, como constava em inquérito policial, se dizia médico diplomado pela Faculdade de Medicina São Paulo, e exercia ilegalmente a profissão atendendo clientes em consultório à Rua do Catumby 2, Rio de Janeiro. O delito está previsto no Código Penal art 156. A ação foi julgada extinta, conforme o Código Penal art 71. Folha Individual Datiloscópica, Gabinete de Identificação e Estatística Criminal, 1933; Decreto nº 4780 de 1923, artigo 33; Decreto nº 20930 de 1952, artigos 58 e 59.
