O autor, mulher casada, de nacionalidade belga se casou com o réu e vieram morar no Brasil. O marido abandonou a mulher que passou a viver honestamente em companhia de seus pais. Com fundamento na Lei Belga e no Código Civil Brasileiro, artigo 317 , número IV, ela requer o desquite. O réu estava em lugar incerto e não conhecido.
