O autor, comandante do vapor americano Wilhelmina, autorizado pela lei nº 221 de 20/11/1894, artigo 52, agravou para o Supremo Tribunal Federal do despacho que lhe denegou apelação da sentença homologatória do arbitramento procedido sobre a colisão do Sargento Albuquerque e seu navio. Houve pedido de agravo e em 28/10/1916 o STF negou provimento (ação improcedente). Decreto nº 848 de 11/10/1890, artigo 337; Regulamento nº 737 de 1850, artigo 369; Código Comercial, artigo 750.
