O paciente requereu uma ordem de habeas corpus por achar-se preso na casa de detenção sem nota de culpa. Foi detido e autuado em flagrante na delegacia do 3o. Distrito Policial pelo crime previsto na Consolidação das leis penais, artigo 251. O juiz denegou a ordem de habeas corpus requerida. Certificado do Registro da Dívida Ativa, Procuradoria Geral da Fazenda Pública, 1937; Constituição Federal, artigo 113 no. 23; Decreto nº 848 de 1890, artigo 48.
